These Terms of Service ("Terms") constitute a legally binding agreement between 1inalltravel ("we," "us," or "our"), a travel CRM and workflow automation SaaS provider operating out of Kolkata, India, and you, whether personally or on behalf of an entity ("you," "User," or "Subscriber").

By accessing or using our Website and our CRM software platform (the "Service"), you agree that you have read, understood, and agreed to be bound by all of these Terms. **If you do not agree with all of these Terms, you are expressly prohibited from using the Service.**

### 1. Eligibility and Account Registration * **Business Use Only:** Our platform is a B2B application built explicitly for travel agencies, tour operators, and independent travel professionals. * **Account Security:** To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update it promptly. You are entirely responsible for safeguarding your login credentials and for any activities that occur under your account.

### 2. Software License and Permitted Use * **Limited License:** We grant you a non-exclusive, non-transferable, revocable, limited license to access and use our CRM platform solely for your business's travel-related operations during your active subscription term. * **Prohibited Activities:** You agree not to: * Reverse engineer, decompile, or extract the source code of our platform or dynamic workflow engines. * Use the Service to store or transmit defamatory, unlawful, harassing, or malicious data. * Attempt to breach or bypass security, authentication protocols, or system architecture limits. * Resell, rent, or lease access to the platform as a standalone product to third parties without express written authorization.

### 3. Subscription Fees, Billing, and Taxes * **Subscription Model:** Access to our CRM platform is granted on a recurring subscription basis (monthly, quarterly, or annually) depending on your selected tier. * **Pricing & Invoicing:** All fees are explicitly detailed on our pricing pages. You agree to pay all applicable fees through our designated payment processors. * **Taxes:** For subscribers located within India, Goods and Services Tax (GST) will be charged at the applicable statutory rate. You are responsible for providing your valid GSTIN to claim Input Tax Credit (ITC). * **Refunds:** All subscription charges are non-refundable unless specified otherwise in writing or required under mandatory consumer protection provisions.

### 4. Data Ownership and Compliance * **Your Content:** You retain full ownership of all data, text, customer profiles, passport copies, and itinerary details that you upload into the CRM ("Subscriber Content"). * **Compliance Obligations:** As the owner/uploader of subscriber content, you explicitly warrant that you have obtained all necessary, valid, and lawful consents from your clients (the end-travelers) to process their data via our system, in strict alignment with India's Digital Personal Data Protection (DPDP) Act, 2023, and global frameworks like GDPR.

### 5. Uptime, Maintenance, and Support While we endeavor to provide maximum system uptime (target 99.9%), 1inalltravel may occasionally be unavailable for scheduled maintenance, system optimizations, or emergency patches. We will notify subscribers in advance of scheduled downtimes whenever possible. We are not liable for business interruptions caused by server downtimes beyond our reasonable control or third-party cloud infrastructure failures.

### 6. Limitation of Liability To the maximum extent permitted by applicable Indian law, 1inalltravel, its directors, employees, or partners, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, goodwill, or other intangible losses, resulting from: * Your use or inability to use the CRM software. * Unauthorized access to or alteration of your customer data resulting from credential compromise. * Statements or conduct of any third party on the Service.

### 7. Indemnification You agree to defend, indemnify, and hold harmless 1inalltravel, its affiliates, officers, and employees from and against any claims, damages, liabilities, costs, or demands (including reasonable legal fees) arising from your breach of these Terms, misuse of the Service, or violation of data privacy rights of your end-customers.

### 8. Governing Law and Jurisdiction These Terms and your use of the platform shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal actions, disputes, or proceedings arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in **Kolkata, West Bengal, India**.
